01Who we are & what this covers

This Privacy Policy explains how Sweatsonic Inc.  (“SweatSonic,” “we,” “us,” or “our”) collects, uses, shares, and protects information when you use our websites, mobile and connected-device apps, and related services, including the SweatSonic creator marketplace and workout content (together, the “Services”).

By using the Services, you acknowledge the practices described here. If you do not agree with this Policy, please do not use the Services. Some jurisdictions give you specific rights and controls, which are described in Section 8.

02Information we collect

Information you provide to us

• Account & profile: name, email, username, password, and any profile details or preferences you add.
• Fitness & activity inputs: workouts you select or complete, cadence and rep data, goals, activity history, and any body metrics, preferences, or wellness information you choose to provide. See Section 3.
• User content: photos, videos, audio, comments, and other content you upload, post, or share through the Services.
• Payment & billing: subscription and transaction details. Card payments are processed by our payment processor (currently Stripe); we do not store full payment-card numbers on our systems.
• Creator information: if you join as a creator, we collect the information needed to onboard and pay you, which may include legal name, business details, tax identification, and payout information.
• Communications & support: messages you send us, survey responses, and support requests.

Information we collect automatically

• Device & usage: device identifiers, browser and operating system, app version, pages and features used, interactions, crash and performance data.
• Approximate location: derived from your IP address or device settings (we do not collect precise GPS location unless you enable it for a specific feature).
• Cookies & similar technologies: as described in Section 7.

Information from third parties

• Sign-in or social login providers, if you connect an account.
• Analytics, advertising, and measurement partners.
• Creators, referral sources, and business partners who share information consistent with their own policies.

03Consumer health & fitness data

Because SweatSonic is a fitness service, some information we handle may qualify as “consumer health data” under laws such as the Washington My Health My Data Act, the Nevada Consumer Health Data Privacy Law, and similar state laws. This can include fitness activity, workout performance, cadence and rep data, goals, and any wellness or body-related information you provide, as well as inferences we draw from it.

Where these laws apply, we:

• Collect and use consumer health data only to provide and improve the Services you request, or with your consent;
• Do not sell consumer health data without your separate, valid authorization;
• Share consumer health data with service providers only under contracts that limit their use of it; and
• Honor your rights to access, delete, and withdraw consent, as described in Section 8.

04How we use your information

We use information to:

• Provide, operate, and maintain the Services, including your account and subscriptions;
• Personalize your experience, including AI-assisted workout suggestions and custom programming (see Section 5);
• Create, edit, and deliver workout content, including AI-assisted editing of certain thumbnails and media;
• Process payments and manage creator payouts;
• Communicate with you about updates, features, security, and support;
• Send marketing and promotional messages, where permitted, which you can opt out of;
• Measure, analyze, and improve the Services;
• Protect the safety, integrity, and security of the Services and our users; and
• Comply with legal obligations and enforce our terms.

05AI & automated personalization

We use artificial intelligence and machine-learning tools to help operate and improve the Services. Specifically, we use AI to:

• Personalize workouts — generate suggested workouts tailored to your activity, goals, and preferences;
• Build custom programming — assemble individualized training plans and recommendations; and
• Assist content production — AI-assisted editing of certain workout thumbnails and media.

These features are designed to support your experience and are not used to make decisions that produce legal or similarly significant effects about you without meaningful human involvement. AI-generated suggestions are informational and are not medical advice. You can contact us at sweatsonic@gmail.com to ask about our use of automated processing, and, where applicable law provides, to opt out of certain automated decision-making or profiling.

We may use AI service providers to deliver these features; they are bound by contract to use your information only to provide services to us and not for their own purposes.

06How we share information

We share information in the following ways:

• Service providers / processors: vendors that host our infrastructure, process payments (e.g., Stripe), provide analytics, power AI personalization and media editing, deliver communications, and support customer service. They may access information only to perform services for us.
• Creators and other users: where the Services are collaborative or social, certain profile and content information is shared as part of how those features work.
• Advertising & analytics partners: we may share limited identifiers and usage data for measurement and advertising. Depending on your jurisdiction, this may be considered a “sale” or “sharing”/“targeted advertising,” which you can opt out of — see Section 8.
• Legal, safety & compliance: to comply with law, respond to lawful requests, enforce our terms, or protect the rights, safety, and property of SweatSonic, our users, or the public.
• Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

07Cookies & tracking technologies

We and our partners use cookies, SDKs, pixels, and similar technologies to run the Services, remember your preferences, measure performance, and support marketing. Categories include:

• Essential — required for the Services to function.
• Analytics — help us understand how the Services are used.
• Advertising — support relevant marketing and measurement.

You can control cookies through your browser or device settings and, where offered, through our in-product preferences. Where required, we obtain consent before setting non-essential cookies and honor recognized opt-out signals such as GPC.

08Your privacy rights

Depending on where you live, you may have some or all of the following rights. We do not discriminate against you for exercising them.

All users

• Access, update, or correct your account information in-app;
• Opt out of marketing emails via the unsubscribe link;
• Delete your account (see Section 9).

California (CCPA/CPRA)

California residents may request to know, access, correct, and delete their personal information; opt out of the “sale” or “sharing” of personal information; and limit the use of sensitive personal information. The categories of personal information we collect are summarized below.

We collect these from you, automatically through your use of the Services, and from the third parties described in Section 2, for the purposes in Section 4. To opt out of sale/sharing, use a GPC signal.

Other U.S. states

Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Texas, Oregon, Montana, and others) may have rights to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising, sale, and certain profiling. You may also appeal a decision on your request; if we deny an appeal, we will explain how to contact your state attorney general.

Consumer health data (Washington, Nevada & similar)

You may confirm whether we process your consumer health data, access it, delete it, and withdraw consent to its collection and sharing. See Section 3.

EEA, UK & other international users (GDPR/UK GDPR)

Where applicable, our legal bases for processing are performance of a contract, our legitimate interests, your consent, and compliance with legal obligations. You may access, rectify, erase, restrict, or object to processing; obtain a portable copy; and withdraw consent at any time. You may also lodge a complaint with your local supervisory authority.

How to exercise your rights

Submit a request to sweatsonic@gmail.comor via. We will verify your identity and respond within the timeframes required by law. You may use an authorized agent where permitted.

09Data retention & deletion

We keep personal information for as long as your account is active or as needed to provide the Services, and afterward only as required for legitimate business or legal purposes.

When you delete your account, we delete the personal data associated with it. Limited information may be retained where necessary to comply with legal obligations, resolve disputes, prevent fraud or abuse, or enforce our agreements, and residual copies may persist in secure backups until they are overwritten on our regular backup cycle. We may also retain de-identified or aggregated data that can no longer reasonably be linked to you.

10Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and access controls. Storage locations holding user content are configured to restrict public access. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your information, we will notify you and regulators as required by law.

11Children's privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from them. Users under 18 (or the age of majority where they live) should use the Services only with the involvement of a parent or guardian. If we learn we have collected personal information from a child under 13 without proper consent, we will delete it. Contact sweatsonic@gmail.com with any concerns.

12International users & data transfers

We operate in the United States, and your information may be processed in the U.S. and other countries with different data-protection laws. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers. By using the Services, you understand your information may be transferred to and processed in the U.S.

13Third-party links & services

The Services may link to or integrate with third-party sites and services we do not control. Their privacy practices are governed by their own policies, and we encourage you to review them.

14Changes to this policy

We may update this Policy from time to time. When we make material changes, we will update the “Last updated” date and, where required, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Policy.
