This Medical Disclaimer & Release of Liability (this “Release”) applies to your participation in any exercise program, workout content, personalized or AI-generated programming, class, event, or equipment offered or made available by SweatSonic Inc. (“SweatSonic,” “we,” or “us”). It supplements our Terms of Service and Privacy Policy. By accepting this Release or by participating in any SweatSonic program or activity, you agree to its terms.
I understand that participating in any exercise program, diet or nutrition guidance, fitness activity, or use of any equipment offered by SweatSonic involves inherent risks. These risks include, without limitation, muscle strains, sprains, fractures, cardiovascular events, aggravation of pre-existing conditions, and other physical injury, up to and including permanent disability or death.
Knowing these risks, I voluntarily choose to participate, and I knowingly and freely assume all such risks, both known and unknown, that arise from my participation.
TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY RELEASE, WAIVE, AND DISCHARGE SweatSonic Inc., and its affiliates, owners, officers, employees, creators, instructors, and agents (the “Released Parties”), from any and all claims, demands, causes of action, and liabilities of any kind — INCLUDING THOSE ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES — for any injury, illness, death, loss, or damage arising out of or related to my participation in any SweatSonic program, activity, or use of equipment.
This release expressly covers claims based on ordinary negligence. It does not release, and I do not waive, any claim that cannot be released under applicable law, including claims for gross negligence, recklessness, willful or intentional misconduct, or fraud. If any part of this release is held unenforceable, the remainder stays in effect and the release applies to the maximum extent the law allows.
To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims brought by me or on my behalf arising out of my participation, except to the extent such claims result from the Released Parties' gross negligence or willful misconduct.
The guidance, content, and resources provided by SweatSonic — including workout suggestions, custom programming, and AI-generated recommendations — are for general informational purposes only and are not medical advice and not a substitute for professional diagnosis, treatment, or advice from a qualified healthcare provider. I will not disregard or delay seeking professional medical advice because of anything provided by SweatSonic.
I confirm that I am participating voluntarily. I have either consulted a healthcare professional about my participation in SweatSonic's programs, or I have chosen to participate without doing so and accept full responsibility for that decision. I understand SweatSonic recommends obtaining medical clearance before beginning any new exercise program.
I represent that, to the best of my knowledge, I have no medical condition, injury, or limitation that would make participation unsafe — or, if I do, that I have obtained medical clearance to participate. I agree to disclose to SweatSonic any condition, disability, or limitation that may affect my participation where relevant, and to stop exercising immediately and seek medical attention if I experience pain, dizziness, shortness of breath, or other warning signs.
I affirm that I am at least 18 years old and have the legal capacity to enter into this Release. If a participant is a minor, a parent or legal guardian must review and accept this Release on the minor's behalf, agreeing to its terms (including the release and indemnity provisions) for themselves and the minor to the extent permitted by law.
I understand that results vary from person to person and that SweatSonic makes no guarantee regarding any specific fitness, health, weight, or performance outcome.
I represent that I have, or am responsible for obtaining, health insurance adequate to cover any injury I may suffer while participating, or I agree to bear those costs myself. The Released Parties are not responsible for medical or related expenses I incur.
All content provided by SweatSonic, whether through its website, applications, or other means, is provided for informational purposes only, on an “as is” basis. It is not exhaustive and should not be relied upon as complete, current, or appropriate for my individual circumstances.
In the event of a medical emergency, I will immediately contact emergency services (such as 911) and will not rely on SweatSonic for emergency medical assistance.
This Release is governed by the laws of the State of Dover, Delaware without regard to its conflict-of-laws rules. It is intended to be as broad and inclusive as permitted by law; if any provision is found unenforceable, the remaining provisions remain in full effect. This Release binds my heirs, successors, and assigns, and survives the termination of my use of the Services.
By participating in any SweatSonic program or activity, I acknowledge that I have read and understood this Medical Disclaimer & Release of Liability and agree to be bound by it. Where accepted electronically, my electronic acceptance is the legal equivalent of my signature.
